1 Confirmation of Booking 1.1 Bookings must be confirmed in writing by post or email by you, the client. At this point you agree to these terms and conditions. 1.2 For Weddings and private functions a deposit of 50% of the total draft invoice must be received 90 days prior to the event. For corporate events the full invoice will be sent after the event. 1.3 Final Numbers, Timings, Menus and any special requirements must be confirmed to Creations Event Caterers Limited no later than 21 working days prior to the event. The details provided at this point will be used to produce your final invoice. Any additional costs incurred after this point will be invoiced after the event. 1.4 If the event requires a bar facility only there will be a fee made of £200 plus VAT. This fee must be paid in full 14 days prior to the event date.
2 Cancellation Charges 2.1 In the event of a reservation having been confirmed in writing and then cancelled, the following charges will be incurred, based on the latest number of guests at the agreed price per head. Cancellation received within 45 days of reserve date 50% of invoice Cancellation received within 30 days of reserve date 75% of invoice Cancellation received within 21 days of reserve date 100% of invoice
3 Payment Payment of the final invoice must be paid 14 days in advance of your event. Any invoices sent after the event must be settled within 14 days. When accounts are not settled within 14 days, interest will be payable thereon until the date of payment at the rate of 5% every 14 days thereafter. The Client agrees to indemnify Creations Event Caterers Limited all the costs of collection of outstanding accounts, including court fees, solicitors' charges and agents' charges that may be incurred.
4 Variations to the Price All prices quoted or listed by Creations Event Caterers Limited are based on the prices ruling at the time of quotation and do not constitute an order. Prices may be subject to adjustment prior to the service being provided to cover any increase in such price or in taxation or duty or increase in the cost of labour or in the event of the booking being reduced in duration or numbers of persons attending. All such quoted prices are exclusive of Value Added Tax.
5 Clients' use of Creations Event Caterers Limited Facilities The hirer shall pay for any loss or damage to any fixtures, fittings and equipment which are caused by the hirer or his guests. We will not be held responsible for loss or damage to any article brought onto the premises.
6 Liability of Creations Event Caterers Limited Creations Event Caterers Limited accept no liability under any claim whatsoever arising (be it by negligence or otherwise) for any loss over the figure of £10,000.00 or such greater figure as it is from time to time the limit of liability laid down by our insurers in respect of such claims so far as may be permitted by law.
7 Force Majeure Creations Event Caterers Limited shall incur no liability to the Client if performance of the contract is prevented or hindered by any case whatsoever beyond Creations Event Caterers Limited control and in particular but without prejudice to the generality of the foregoing, by act of God, war, riot, civil commotion, Government controls, restrictions or prohibitions or any other Government act or omission whether local or national fire, flood, subsidence, sabotage, accident, strike or lock out and shall not be liable for any loss or damage resulting therefrom suffered by the Client.
